Annoncée, la constitution du 18 février 2006 telle que modifiée à ce jour ne s’éclipsera pas au criblage de la modification. S’il est vrai que le changement de la constitution est souvent l’oeuvre d’un tyran, il n’en demeure pas moins que ce changement soit l’oeuvre du pouvoir constituant dérivé. Usant de la technique de double révision, le constituant dérivé parvient, comme c’est le cas lors d’un putsch, au changement de constitution. Loin de rencontrer la volonté populaire, le changement de la constitution se penche vers l’autoritarisme du pouvoir politique. Seule l’intervention du juge constitutionnel, dans le cadre de la judiciarisation des lois constitutionnelles, est à la rescousse de la constitution entreprise.

Using the double revision technique, the derived constituent succeeds, as is the case during a putsch, in changing the constitution.
