Lorsqu’il s’agit de réfléchir sur le remplacement d’un organe humain par un autre au cours d’un traitement médical, plusieurs questions d’ordre éthique se soulèvent. Ces questions poussent parfois la crainte jusqu’au niveau d’imaginer que l’être humain vivant ou décédé risque d’être considéré comme un réservoir d’organes pouvant servir au traitement d’une personne malade. Pourtant cette dernière a le droit de rechercher des soins. Savoir si ses droits iraient jusqu’à exiger des organes humains permet d’analyser la question sous un angle peu traditionnel. Le prélèvement d’organes est analysé en principal alors que la greffe d’organes est étudiée en parallèle. Cet article se propose de scruter les textes les plus avancés, au moment de la rédaction, dans le but de vérifier la perspective dans laquelle les rédacteurs se sont placés et plus particulièrement pour servir de laboratoire pour une probable prise de position au niveau continental africain.

Abstract

The think about the replacement of human organ by another during medical treatment, several questions relating to ethical issues rise. These issues tend to raise the conception that human beings, dead or alive, are a kind of organ recipient that is available for medical treatment of a patient. Yet a patient has the right to seek for medical care. The analysis of whether his right may include the claim of human organs allows an interesting discussion that seems a bit traditional. The removal is analysed in a general way when the transplant is studied in parallel. This paper aims at scanning the existing legal instruments at the time of it writing and that are in advance on the topic. The author tries to examine on which point of view the drafters of these legal instruments placed themselves when addressing the question on human organ transplantation. This is with the view to serve as an example for the African continent.
